PUBLIC SERVANT DATA REDACTION REQUEST

FREQUENTLY ASKED QUESTIONS

  1. What is a Public Servant Redaction Request?

Under the New Jersey statute known as “Daniel’s Law,” the Missouri Judicial Privacy Act, the Oklahoma Judicial Privacy Act, or other similar state laws, certain public servants may request that their protected information is not disclosed or made available on a website. You must meet the definition of a “covered person” to be entitled to this right.

  2. Who is a “covered person”?

The definition of a covered person depends on which law you are making a request under, but typically includes those who, due to the nature of their public roles, face heightened safety risks. The categories may include judicial officers (judges, magistrates); law enforcement officials (police, detectives, prosecutors); and members of their immediate household.

  3. Who can submit a redaction request?

Only specific people (“authorized persons”) can submit a request to redact protected information. Typically, this includes:
    • the covered person themselves
    • immediate family members living in the same household as the covered person
    • the legal representative of a covered person who is deceased or unable to act (i.e., an executor or power of attorney)
    • parents or guardians of minors of a covered person
    • a designated person from the U.S. Marshals Service or the Clerk of the U.S. District Court can act on behalf of federal judges

  4. What Information is protected?

“Protected information” of covered persons is defined in the applicable law but typically includes home addresses and unpublished telephone numbers.

  5. I am a covered person - do you have my protected information?
